Privacy Policy

I. General Principles for Processing Personal Data

TLA Smoczyński Koniewski Doradztwo Podatkowe Sp. z o.o. (hereinafter referred to as TLA) takes all necessary measures to protect the privacy of individuals using our websites. This Privacy Policy outlines how we ensure security and privacy of personal data as well as process and protect personal data.

The guiding principle of our websites, tla-kancelaria.pl, tla-kancelaria.pl/ceny-transferowe/, and tla-kancelaria.pl/sklep/ (hereinafter referred to as the “Service”), is compliance with all applicable legal regulations regarding privacy and personal data protection.

Using the websites of the Service does not require registration; therefore, if you are merely visiting our website, we do not collect any personal information about you, except for limited data related to the use of cookies, as described below.

However, if you decide to contact TLA, subscribe to the Newsletter, or make purchases via the online store available through the Service, providing personal data will be required. In such cases, TLA may also contact the individuals whose data is collected, inviting them to participate in special events, sharing information about publications or events, or for other marketing purposes, provided they have given their consent.

TLA is committed to maintaining the confidentiality and security of personal data obtained in the course of its operations. Additionally, TLA has implemented procedures to protect information against loss, misuse, and unauthorized disclosure.

II. Personal Data Controller

  1. The Controller for information collected via the Service is TLA Smoczyński Koniewski Doradztwo Podatkowe Sp. z o.o., headquartered in Wrocław at ul. Włodkowica 12/6 (50-072). The company is registered in the National Court Register maintained by the District Court for Wrocław-Fabryczna in Wrocław, VI Commercial Division of the National Court Register, under KRS number: 0000346357, NIP: 8971758376, with a share capital of PLN 34,000.00.

The Controller processes Users’ personal data in compliance with applicable legal regulations, including, in particular:
the Act of May 10, 2018, on the Protection of Personal Data (Journal of Laws of 2018, item 1000, as amended),
Regulation (EU) 2016/679 of the European Parliament and of the Council of April 27, 2016, on the protection of natural persons concerning the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (General Data Protection Regulation) (OJ EU L. 2016.119.1 of May 4, 2016, hereinafter: GDPR),
the Act of July 18, 2002, on the Provision of Electronic Services (Journal of Laws of 2017, item 1219, as amended).

  • The Service collects information about users and their behavior in the following ways:
    • through voluntarily provided information entered into forms,
    • through cookies stored on end-user devices.

III. Purposes and Legal Bases for Processing Personal Data

  1. The Service respects users’ rights to privacy. The data provided by users are used and processed by the Collector for the following purposes:
    1. Ongoing Communication TLA Smoczyński Koniewski Doradztwo Podatkowe Sp. z o.o. (hereinafter: TLA) in response to a contact request submitted via the contact form, i.e., with the consent of the data subject, to enter into and perform a contract to which the data subject is a party, and based of the Collector’s legitimate interest under Article 6(1)(a) GDPR, Article 6(1)(b) GDPR, and Article 6(1)(f) GDPR.
    2. Facilitating sales of products offered by the Collector (access to digital content, conducting online training), including proper transaction processing, based on consent provided during registration to the Service and for the purpose of entering into and performing a contract to which the data subject is a party, as well as fulfilling the Collector’s legitimate interest, under Article 6(1)(a) GDPR, Article 6(1)(b) GDPR, and Article 6(1)(f) GDPR.
    3. Processing of complaints, pursuing its own claims and defending against mutual claims, fulfilling the legitimate interests of the Collector, under Article 6(1)(f) GDPR.
    4. Storing user’s mailing data on the Collector’s servers under Article 6(1)(a) GDPR and Article 6(1)(b) GDPR.
    5. Marketing activities based on the user’s consent and fulfilling the legitimate interests of the Collector under Article 6(1)(a) GDPR and Article 6(1)(f) GDPR.

For any other purposes, user-provided data may only be used upon prior and explicit consent. The Collector declares that the data provided by users will never be sold, exchanged, or otherwise transferred unlawfully.

  • The data entered in forms may be shared with entities that technically implement certain services, including:
    • Providers and supporters of the Collector’s IT systems for Service operation and entities providing services related to the Collector’s ongoing activities,
    • Entities cooperating in the Service’s operation—under appropriate data processing agreements.

In such cases, the Collector shares only the data necessary to perform the specific activity properly.

  • The Collector may be required to disclose information collected via the Service to authorized authorities based on lawful requests and to the extent required by such requests.

IV. Processing of Personal Data

  1. The Service collects information voluntarily provided by the user, as described in Section 3 below.
  2. The Service may also store information about connection parameters (timestamp, IP address).
  3. Use of the services offered through the Service may require providing the following personal data:
    1. First and last name,
    2. Company name,
    3. Position,
    4. Email address.
  4. Contacting TLA, subscribing to the Newsletter, or using the TLA Store requires disclosure of personal data. Disclosure of personal data is voluntary but necessary for contacting TLA, subscribing to the Newsletter, or using the TLA Store.
  5. Personal data will be processed by the Collector for the duration of email correspondence, newsletter distribution, or order fulfillment, or until data subject objects to processing. Where processing is based on the data subject’s consent, the processing will continue until the consent is withdrawn. Additionally, data will be processed as required by law or for the purpose of securing potential claims.
  6. In accordance with Articles 15–22 of the GDPR (Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC). The data subject shall have the following rights:
    right to access their data, right to rectify their data, right to erase their data, right to restrict processing, right to object to processing, right to data portability, right to withdraw their consent to the processing of personal data at any time without affecting the lawfulness of processing based on consent before its withdrawal.
  7. In case of doubts regarding the processing of personal data, data subjects may request information from the Collector. Additionally, data subjects have the right to lodge a complaint with the supervisory authority – the President of the Personal Data Protection Office.

V. Cookies and Server Logs

  1. The Service collects standard login-related information, such as IP address, browser type, language, access times, and the referring website address, to ensure proper website administration. TLA may, therefore, use cookies. The use of cookies (except for those necessary for the operation of the Service) is carried out only with the user’s consent, expressed in the cookie banner. If consent is withdrawn, cookies will be removed from the user’s device.
  2. Cookies are small text files stored on an end device (such as a computer or tablet) that can be read by TLA’s IT system or the IT system of other entities (via social media tools). The user can change their cookie settings at any time using the tool provided in the Service’s banner.
    • Cookies are used for:
      • Creating statistics,
      • Customizing the Service’s content to the user’s needs,
      • Ensuring the proper operation of the Service.
  3. Cookies are intended for use on the Service’s websites, particularly for creating statistics and adjusting the content of the Service to the user’s needs, specifically by correctly displaying the website, tailored to the individual user’s requirements.
  4. The Service includes the following cookie options, which can be selected using the tool in the cookie banner:
    • Personalized – The highest level of personalization. Data is shared to increase the relevance of ads and media. Data may be transferred to third parties and used to track the user on this and other visited websites.
    • Balanced – A balanced level of privacy. Data is available for content personalization and website optimization. Data shared with third parties may be used for tracking and storing the user’s preferences for this website.
    • Private – The highest level of privacy. Access to data is limited to necessary, basic operations. Data is transferred to third parties solely to ensure the security of the website and its functionality on the user’s device.
  5. Information about certain user behaviors is subject to logging. This data is used for the administration of the Service and involves sending queries to the server where the Service’s web pages are stored. Logs may include, in particular, the IP address, date, operating system details, and browser information. Logs serve as auxiliary material for administering the Service’s pages to ensure the most efficient operation of the Service.
  6. The entity placing cookies on the user’s end device and accessing them is the Service operator. The Service may also use cookies from third parties (particularly Google AdWords, YouTube, and/or social media tools provided especially by Twitter and LinkedIn).
  7. By default, web browsers typically allow cookies to be stored on the user’s device. However, Service users can modify their settings in this regard. Web browsers enable users to delete cookies, as well as to automatically block cookies. Detailed information on this can be found in the help section or documentation of the web browser.
  8. Restrictions on the use of cookies may affect certain functionalities available on the Service’s websites.
  9. Cookies may also be used to support advertisements run via Google AdWords and/or Google Analytics, particularly for remarketing and dynamic remarketing. Each user can opt out of cookies being placed on their device by changing their web browser settings (as described in Section 6 above) and by using Google Analytics blocking tools available here: https://tools.google.com/dlpage/gaoptout/.

VI. Final Provisions

  1. For matters not regulated by this Privacy Policy, the provisions of applicable law, including in particular the Personal Data Protection Act and/or the GDPR, shall apply.
  2. TLA may modify the content of this Privacy Policy, notifying users by publishing the updated Privacy Policy on the Service’s websites. Users whose email addresses are in TLA’s mailing database due to using services offered through the Service will also be informed of changes via email. Users may refuse to accept the changes by notifying the data administrator at the provided contact address.
